Please read these Terms and Conditions carefully, by using our Site or Services you agree to be bound by these Terms and Conditions.
Our Site and Booking Services offer clients the ability to book and purchase private Yoga Classes and Class Places within Private Group Classes. Classes take place at the clients chosen home, office or hotel location. Classes are currently available for booking within London.
Our Site acts as a booking platform, facilitating bookings between Clients and Teachers.
The Classes are provided by independent, freelance teachers. As such, Yoga Team acts purely as a Conduit booking facility and we hold no responsibility for any Classes which are booked or purchased through our Site. Our responsibility is solely for enabling the booking and purchasing process.
We do not employ any of the teachers. In line with our agreed Terms with our Teachers, our Teachers appoint us to act as solely as their booking platform and conclude bookings on their behalf, by collecting the Class Fee, using our secure third-party payment processor. The Class Fee charged to the Client belongs to and is paid to the Teacher. Yoga Team collects an agreed Commission Fee from each Teacher for each successful booking for our role in managing the booking platform.
Yoga Team is neither responsible nor liable for the actual Class Services provided by the Teacher. As such, You and the Teacher are responsible for any taxes arising as a result of the Services.
Inclusion and representation in our Teaching Team is on an invitation only basis, following our interview process which includes an interview with Yoga Team Management, practical teaching demonstration, and referencing of relevant experience and training qualifications, and insurance documentation. Whilst all effort is made to ensure teaching of the highest quality as an agency we do not guarantee or warrant and we make no representation whatsoever regarding, the reliability, quality or suitability of the Teachers
In these Terms and Conditions, unless the context otherwise requires, the following expressions shall be interpreted as having the following meanings:
“Business” means any business, trade, craft, or profession carried on by You or any other person/organisation;
“Class Services” means the Class Services provided by the Teacher to Client.
“Class Fee” means the relevant fee payable in respect of Class Services (as detailed on the Site and in the Fees section of these Terms).
“Class” means a Private Class (either as a 1-1 or shared by up to 4 people), held at the clients designated location
“Class Place” means a Class Place for an individual within a group class, held at an agreed place of work, at which the attendee is a registered employee or invited member
“Class Credit” means a 60, 75 or 90 Minute Credit for the applicable Class Length.
“Client Account” means the Account on the Yoga Team website which holds all pre-purchased Class Credits and displays the booking history and booked classes
“Client” means the individual who books a Yoga Class or Class Place through the Site and to whom the Class Services are provided by a Teacher.
“Commission” means the commission payable by the Teacher to Yoga Team in respect of each Booking
“Corporate Class" means the group class delivered by an independent teacher at the corporate client’s office.
“Yoga Class” means any group session at which We provide or lead any physical exercise class, including any teaching, instruction, or training and all facilities, services, equipment, and other goods and materials which we provide/use in connection with any such Yoga Class; *
“Private Class” means the class delivered by an independent teacher at the client’s chosen home or hotel location
“Premises” means the premises at which the Classes take place;
“Price List” means the standard price list for booking all Classes offered.
“Registration Form” means the registration form that We provide to You for You to apply to register;
“Site” means http://www.yoga-team.co.uk and any Sub-Domains;
“Site Services” means the provision of the Site by Yoga Team for the purpose of facilitating Bookings of Class Services, effecting introductions of Teachers to Clients, and where relevant setting up corporate classes for clients to book into, and the collection of payment for Bookings together with telephone and Booking Team services as support.
“Teacher” means the person introduced by Yoga Team to the Client for the provision of Class Services;
“We/Us/Our” means Yoga Team Limited whose place of business and contact address is below and includes all Our own staff (employees and agents);
“Yoga Team” means Yoga Team Limited. A company registered in England and Wales with company number 6565174 whose registered office address is Victoria Villas, Ewald Road, London, SW6 3ND, VAT Number: GB 138 8315 94
“You/Your” means an individual or corporate body to whom We agree to provide any Yoga Class access.
Unless the context otherwise requires, each reference in these Terms and Conditions to: “these Terms and Conditions” is a reference to these Terms and Conditions; and a Clause or sub-Clause is a reference to a Clause of these Terms and Conditions;
The headings used in these Terms and Conditions are for convenience only and shall not affect the interpretation of these Terms and Conditions;
Words signifying the singular number shall include the plural and vice versa; and References to any gender shall include the other usually inferred gender or persons self-identifying as holding themselves with no gender or neutral gender.In order to book any Class via our site You first have to register with Us and You may do so by completing the Registration Form and agreeing in that Form to these Terms and Conditions, forming a contract between You and Us on these Terms and Conditions for the use of our services
The details that You provide and confirm in the Registration Form must be complete and correct, and this includes Your confirmation that You are 18 or over, and that You agree to these Terms and Conditions, including but not limited to the fitness, health and safety matters and the advisory notes and disclaimers set out in these Terms and Conditions.
You may book and attend a Class only once We have accepted Your booking. Our decision whether or not to accept Your application to register or book with us is in Our absolute discretion.
Our site enables you to select a teacher, view their teaching specialisms and an introduction to their Teaching Approach. It is your responsibility to ensure the teacher you choose to book is appropriate for you. You agree to notify your Teacher of any pre-existing medical condition (whether physical or mental) before the start of any class. You are invited to detail any individual requirements or relevant background information on your profile and within the Class Request input tool. Any information disclosed will be treated in confidence in-line with our Privacy Policy
By making a booking through our site or over the phone, you warrant that you agree to provide complete, correct and true information including billing and payment information.
All classes require advanced payment. Our site enables you to purchase Class Credits, which you can then use to book classes.
Your request for a booking for a Yoga Class will be an offer, only when payment has been successfully processed and you have received a ‘Booking Confirmation’ email from us will there be a binding contract between You and Us and that Class.
A Class and Your place in that Class is subject to availability. No priority is given, and places in a Group Classes are allocated on a first-come-first-served basis. Once the class is full no further bookings can be taken via our site.
Private Classes - You may make a booking for a 60, 75 or 90 Minute Yoga Class through our site by selecting a Teacher. It is agreed that our Private Classes are for individuals or groups of up to 4 people, and that all attendees must be registered with Yoga Team and agree to accept these terms to attend the class/classes.
Corporate Classes - Bookings for Class Places within Private Corporate Classes, are by private invitation only and require a company ID to log in. Private details of the class/classes will be shared to a data base of registered users. Registered Users will be approved by the host company.
The payment of the full Class Fee for both Private Classes and Class Places within Corporate classes is due at the point of booking to secure the booking. You will reserve an onscreen confirmation and email confirmation of the booking. It is the client's responsibility to ensure the information given at the point of booking is correct, including but not exclusively to the address.
You must pay in accordance with Our Price List for all Classes Credits (which are inclusive of VAT) that We fully and correctly provide to You via Our Site. Classes must be purchased in advance of booking, in the form of single Class Credits or sets of Class Credits. At the point of each booking the client will be asked to confirm the class booking and assign a Class Credit to complete the booking. Class Credits are saved on Client’s Account, and purchasable via Credit or Debit card payment in Single Classes (of 60,75 or 90 Minute) or sets of 4 or 8 Classes for Private Classes or as a set of 5x 60 Minute Classes for Corporate Classes.
You may pay for the Class Credits by using Our Payment Processing Service which is provided to You via "Stripe".
Credit or Debit Card payments must be authorised by the relevant card issuer, and may be subject to additional security checks, such as Verified by Visa. By making the booking you agree to provide complete,correct and true information, including without limitation billing and payment information. You may be subject to the additional Ts&Cs of the payment processor.
We reserve the right to alter Our prices without prior notice, but if the price of the Class Credits increases between the time when You book it and the date of the Class, the price increase will not apply to You for the Class on that date.
Our Cancellation Policy is 24hours. Cancellations may be made directly via your account on our website.
Classes and Class Places Cancelled with 24hrs Advanced Notice, of the Class Start Time:
All classes cancelled with a minimum of 24hrs advanced notice, prior to the Class Start Time, can be rescheduled. In the event you cancelling your class in advance, the associated Class Credit will be returned to your client account, provided a full 24 hours plus notice is provided by You.
Classes and Class Places Cancelled within 24hrs of the Class Start Time.
All classes and Class Places cancelled with less than 24hrs advanced notice cannot be refunded and the Class Credit cannot be returned
If you book and subsequently cancel on the same day of a class taking place, then no cancellation refund shall be allowed. The Class Credit cannot be returned or refunded.
If you are a 'no-show' for any booked class for whatever reason we reserve the right not to refund or Credit you. We are not obliged to offer you an alternative class in lieu of any 'no-show'.
If You do not cancel or attend the class this will be considered as a ‘No Show’.
We will use all reasonable endeavours to ensure the Class that You have booked is provided, but any cancellations or delays or any other matter related to your satisfaction or quality of the class is a matter for the individual class Teacher and not Yoga Team.
We reserve the right to cancel a booking made by You at any time before the time and date of that class in the following circumstances:
We are informed the class is not taking place; or The required Teacher necessary for the Class is not available
Extending Class Times - all Class Times must be booked in advance. If you wish to extend your Class Length by 15 or 30 Minutes, you must book the additional Class Time in advance (with 4 hours' advance notice), by contacting bookings@yoga-team.co.uk
Classes cannot be extended beyond the allocated booking time, within 4 hours of the class commencement.
Delayed Arrival of Teacher - In the rare instance of your Teacher being delayed, you will be notified of their delay and where possible advised upon an Estimated Arrival Time, and invited to extend the class end time to ensure the booked class length can be delivered. Where this is not suitable or possible, any undelivered class time will be returned to Your Account with Us, and added to a future class of your choosing.
Private Classes (only) - where you are not at the booked class location for the start time of the class,we ask that you notify Yoga Team, and provide an Estimated Arrival Time. It is agreed that classes will finish at the booked class end time, and the teacher will modify the class sequencing to deliver a class which supports the class time remaining. At the sole discretion of Your Teacher, for delays of a maximum of 10 minutes, the teacher will offer a complimentary class extension of up to 10 minutes, where possible and practical.
Corporate Classes - We are only able to accept late-comers, within 5 minutes of the class Start Time, ensuring all participants have engaged with the Class Warm Up, to ensure best practice. Yoga Team reserve the right to refuse admittance to classes to participant who arrive 5 + minutes after the class has started.
You acknowledge that certain Yoga Classes may be physically strenuous and You agree that You voluntarily participate in such Classes with Your full knowledge that even if We and the relevant Teacher is not negligent there is a risk of personal injury or illness arising from Your participation in such Class.
Certain Yoga Classes might be unsuitable for You if You might have any special needs, or any medical, health or fitness problem or condition. Classes are not suitable for certain conditions, including but not exclusive to the first trimester of pregnancy, and we ask that Clients advise upon any known conditions, any injuries, illnesses or health concerns (of any participant)in advance of the class. We reserve the right to cancel Classes, or access to a Class if in Our view it is believed that the class is not suitable for the individual.
It is the Client's own personal responsibility to provide a warm, clean safe and appropriate space for the Class, and to ensure the health and safety of the Teacher and Participants whilst at the designated location. An appropriate space is a room that comfortably accommodates all attendees with sufficient space to enable each person to lie on the floor with both of their arms fully outstretched in any direction without any interference from any person or any object.
You must ensure that you are fit and well enough to participate in any Yoga Class that You book, and should take careful note of any safety tips or special guidance or method instructions from the class Teacher. You will at all times be responsible for Your own state of health,physical condition and wellbeing. If for any reason you feel uncomfortable by your surroundings or any other person, you should notify your class Teacher immediately.
If You have any concerns about Your fitness or health, You should seek appropriate medical advice from a relevant medical professional or other suitable adviser before attending a Class. We and our Teachers cannot and do not provide any such advice or endorse that the Class will be suited to Your needs or expectations.
You agree that when You register and when You book and attend any Class, that will be Your confirmation that You have no obvious or known health or fitness problems which may affect your participation in any Class.
You must not attend any Yoga Class when under the influence of alcohol or prescription or any illegal drugs.
We recommend that you attend in clothing that is suitable for the purposes of Fitness Classes and Yoga, and this should be comfortable for your needs. Loosely swinging or sharp jewellery, and socks should be removed before a Class.
It is Your responsibility to ensure you have the necessary equipment, including a Yoga Mat for Your class.
We request that you treat all Teachers respectfully. Our teachers are entitled to refuse to deliver classes in the event that the conduct of the client is inappropriate in any way.
We will not be liable for any failure or delay in performing Our obligations under the contract resulting from any cause beyond Our reasonable control.
If any event described under sub-Clause 9.1 occurs that is likely to adversely affect Our performance of any obligations under the contract, We will try to inform You as soon as is reasonably possible, Our obligations will be suspended and any time limits that We are bound by will be extended accordingly. We will inform You when that event is over and provide details of any new dates, times or availability of Yoga Classes as necessary. You may, without liability to Us, cancel any Yoga Class(es) which do not take place due to that event, and We will refund in full the advance payment that You have made to Us for the cancelled Class(es).
We will be responsible for any foreseeable loss or damage that You may suffer as a result of Our breach of these Terms and Conditions or as a result of Our negligence. Loss or damage is foreseeable if it is an obvious consequence of Our breach or negligence or if it is contemplated by You and Us when Our contract with You is created. We will not be responsible for any loss or damage that is not foreseeable, or which is not Our fault.
We provide or sell all Yoga Classes to You only for Your personal and private use/purposes. We make no warranty or representation that any services that We provide or sell to You are fit for any purpose other than as described.We state that as reasonably that we can ascertain, that the Teachers we feature and use is appropriately qualified to conduct the particular Class which they conduct but their advice does not include any medical or similar advice and is not a substitute for advice provided by an appropriate medical, health, or fitness professional or therapist. Whilst all efforts are made to ensure the highest standards of teaching, we do not take responsibility for the suitability of the teacher and have no obligation in respect for the service they deliver.
Nothing in these Terms and Conditions is intended to or will exclude or limit Our liability for death or personal injury caused by Our own negligence (including that of Our employees, agents or sub-contractors) or for fraud or fraudulent misrepresentation.
We may from time to time change or amend these Terms and Conditions without giving You notice, but We will use Our reasonable endeavours to inform You as soon as is reasonably possible of any such change. The date of the latest update of Our Terms and Conditions shall appear on Our Website.
All personal information that We may use will be collected, processed, and held in accordance with the provisions of EU Regulation 2016/679 General Data Protection Regulation ("GDPR") and Your rights under the GDPR. For complete details of Our collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of Your rights and how to exercise them, and personal data sharing (where applicable), please refer to Our Privacy Policy.
We reserve the right to change the domain address of this Website and any services, and availability at any time. Any information regarding Your decision to buy from Us is merely an invitation to treat, and no contract is formed until the process is completed and the Order paid for. Our acceptance of Your Order is when a Contract is formed.
Every effort is made to keep information regarding Our service availability on the Website up to date. However, we do not guarantee that this is the case, or that our Website will always be available. The website is made available on an "As is" basis.
If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision in question will not be affected.
All orders and Contracts are concluded in the English language only.
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under it or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with your obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.
You should note that access to Your account on our Website shall only be available during the live term of your membership and will cease on termination of your account. By using Our Service the Client will not enter into any contract or other arrangement directly with any Teacher. The Client accepts that Teachers are contractually obliged to decline all such offers and that any breach of such obligations may lead to legal action and/or the termination of their account with Yoga Team.
These Terms contain the entire Agreement between the parties and replaces any previous agreement.
The Contracts (Rights of Third Parties) Act 1999 shall not apply to this Agreement and no person other than Yoga Team and the Client shall have any rights under it. The terms of this Agreement or any of them may be varied, amended or modified or this Agreement may be suspended, cancelled or terminated by agreement in writing between the parties or this Agreement may be rescinded (in each case), without the consent of any third party.
We always welcome feedback from You and, whilst We always use all reasonable endeavours to ensure that Your experience as Our customer is a positive one, We nevertheless want to hear from You if You have any cause for complaint. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.Law and Jurisdiction
These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England.
Yoga Team promotes a mutual respect and understanding of the body and the mind. We send our gratitudes to you for your respect in honouring our intention to create a positive experience for all who choose to practice with us.
